These terms are between Delta Research Group Ltd ("Delta", "we") and the school named in the order or pilot terms ("the school", "you"). Delta Research Group Ltd is registered in England and Wales, company number 17324839, registered office 127a Westbury Road, Bristol, England, BS9 3AP. You can reach us at research@deltaacademics.com.

1. What these terms cover

1.1 Delta Academics is a web application for pupils applying to university and for the advisers who support them. It is provided at app.deltaconsole.com.

1.2 These terms cover the school's use of Delta Academics, and its use by the advisers and pupils the school admits to it.

1.3 Four documents make up our agreement. If they disagree, the one higher in this list wins:

  1. the data processing agreement, for anything about personal data;
  2. the order or pilot terms signed by the school, for dates, numbers of pupils and price;
  3. these Terms of Use;
  4. the acceptable use policy for pupils and advisers.

1.4 These terms do not cover any other service of Delta Research Group Ltd, including mentoring for individual families.

2. What Delta provides

2.1 Delta provides the tools described in the order or pilot terms, for the pupils and advisers the school adds, for the period agreed there.

2.2 Each tool is switched on for a school separately. A tool is provided only once it has been switched on for the school.

2.3 Delta provides the service with reasonable skill and care. We may improve, change or withdraw a tool. If a change would remove something the school relies on, we will tell the school's lead adviser by email at least 30 days before, unless the change is needed sooner to keep pupils or their information safe.

2.4 We aim to keep Delta available at all times but do not promise that it will never be interrupted. Planned maintenance is done outside UK school hours where we can.

3. What an estimate is

3.1 Delta's estimates describe how applicants with similar published characteristics have fared in past admissions rounds. For Oxford and Cambridge courses an estimate is a range, with the evidence it rests on and how strong that evidence is. For other courses Delta shows published figures for past applicants and each course's typical offer.

3.2 No estimate or figure is a prediction about any one pupil, a promise, a guarantee, or advice about where to apply. Universities read much that Delta cannot see, including the personal statement, the reference, any interview and the rest of the field in that year.

3.3 Decisions about applications rest with the pupil, the school and the universities. The school remains responsible for the guidance it gives.

3.4 Feedback on a personal statement or a practice interview is written with the help of AI, under rules Delta sets, and is released to a pupil only by one of the school's advisers. It is guidance for practice. It is not an assessment by a university and does not show how an admissions tutor would decide.

4. What the school agrees to do

4.1 Choose which pupils use Delta, and add only pupils aged 16 to 18.

4.2 Tell pupils and their parents or carers about Delta before pupils join, using the wording we supply or wording that says at least as much.

4.3 Name a safeguarding lead and keep that person's email address in Delta up to date, so that a concern reaches someone who can act on it.

4.4 Enter each pupil's name only in the fields Delta provides for it, and keep it correct. Delta holds pupils' names for the school, encrypted, and shows them only to the pupil, the school's advisers and its safeguarding lead, as the data processing agreement describes. The school must not put a pupil's name, or any other person's, into a note, a comment, a message, a task or a cohort's name.

4.5 Make sure each adviser has their own account, and remove an adviser's access promptly when they leave or change role.

4.6 Read AI-assisted feedback before releasing it to a pupil.

4.7 Make sure its advisers and pupils follow the acceptable use policy, and tell us promptly if it learns that they have not.

5. Accounts and security

5.1 Advisers sign in with their own email address. Pupils join with a code the school gives them and a passcode they choose. The school is responsible for handing out join codes to the right pupils.

5.2 The school must tell us without delay at research@deltaacademics.com if it believes an account has been used by someone who should not have it, or a join code has reached the wrong person.

5.3 We may reset a code, end a sign-in or pause an account where we reasonably believe it is being misused or is at risk. We will tell the school's lead adviser when we do.

6. What nobody may do with Delta

6.1 The school must not, and must not allow anyone else to:

  • copy, collect or extract Delta's content, figures, questions or estimates by automated means (scraping), or in bulk by any means;
  • reverse engineer, decompile or try to work out the model, the data or the methods behind Delta, except where the law gives a right to do so that cannot be removed by agreement;
  • use Delta, or anything taken from it, to build or improve a product or service that competes with it, or to train an AI system;
  • sell, rent or pass on access to Delta to anyone outside the school;
  • try to get round Delta's security, reach another school's or another pupil's information, or disrupt the service;
  • upload anything unlawful, harmful or that the school has no right to share.

6.2 The school may use Delta's pages, exports and printed sheets for its own guidance of its own pupils, including in meetings with pupils and parents.

7. Who owns what

7.1 Delta Research Group Ltd owns Delta Academics: the software, the design, the model, the course evidence, the question banks, the reading lists and all other content Delta supplies, and the database rights in the data Delta has assembled. Nothing in these terms transfers any of it.

7.2 The school and its pupils keep all rights in what they enter: grades, choices, statements, answers, notes and dates. They give Delta permission to use it only to provide the service to that school, as the data processing agreement sets out. Delta does not use it to train AI or for any purpose of its own.

7.3 If the school gives us suggestions about Delta, we may use them freely. We will not name the school, or quote anyone at it, without written permission.

8. Personal data and safeguarding

8.1 The school is the controller of its pupils' and advisers' personal data and Delta is its processor. The data processing agreement governs that processing and wins over these terms wherever they differ.

8.2 What a pupil writes or says in statement feedback, interview practice, the reading log or a note on a task is read once, by an automated check, for signs that they might need support. Where the check finds any, the item is held and the school's safeguarding lead is emailed the pupil's label, the date and the few words concerned. The check supports the school's own safeguarding. It does not replace it, and it will not find every concern.

9. Price and payment

9.1 The price, if any, is the one in the order or pilot terms. A pilot is free unless the pilot terms say otherwise.

9.2 Where a price is due, we invoice annually in advance and the school pays within 30 days. Prices exclude VAT if applicable.

9.3 If the school ends a paid year early under clause 10.2 because of our breach, we refund the part of the price for the time remaining. Otherwise sums paid are not refundable.

10. Ending and pausing

10.1 The agreement runs for the period in the order or pilot terms. During a pilot either of us may end it at any time with two weeks' notice by email.

10.2 Either of us may end the agreement at once by written notice if the other commits a serious breach and, where it can be put right, has not put it right within 14 days of being asked.

10.3 We may pause the school's access, or one person's access, where that is needed to protect pupils, their information or the service. We will pause only what is needed, tell the school's lead adviser, and restore access as soon as the reason has gone.

10.4 When the agreement ends, the school can first download its cohort data. Delta then deletes the school's pupils' information as the data processing agreement sets out.

11. Our responsibility to the school

11.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow to be limited.

11.2 Subject to clause 11.1, Delta is not liable for: the outcome of any application, including an offer not made or a place not gained; a decision taken by a pupil, a parent or the school; loss of profit, business or reputation; or any indirect loss.

11.3 Subject to clause 11.1, Delta's total liability to the school in any year, however it arises, is limited to the price paid or payable for that year, or GBP 5,000 if greater.

11.4 Liability under the data processing agreement is governed by that agreement.

11.5 Neither of us is liable for a failure caused by something outside our reasonable control, for as long as it lasts.

12. General

12.1 These documents are the whole agreement between us about Delta Academics. A change is made only in writing, agreed by both of us. We may update these terms for all schools on 30 days' notice by email; a school that does not accept an update may end the agreement before it takes effect.

12.2 Neither of us may transfer the agreement without the other's written consent, except that Delta may transfer it to a company that takes over the Delta Academics business, on notice to the school.

12.3 Only the school and Delta may enforce these terms. Pupils, advisers and parents have no rights under them.

12.4 Notices are given by email: to the school's lead adviser, and to Delta at research@deltaacademics.com.

12.5 If part of these terms cannot be enforced, the rest still applies.

13. Law and courts

13.1 These terms are governed by the law of England and Wales, and the courts of England and Wales decide any dispute. For a school outside the United Kingdom: as clauses 12 and 13 of the data processing agreement provide.
